Terms of Service
Version 2026-10-16
These terms are an agreement between BallotData LLC (“BallotData”, “we”) and the person or organization that buys a subscription (“you”). By checking out you agree to them on behalf of yourself and, if you name one, your organization.
1. What you buy
- A subscription gives you access, for its term, to the recommendations data and Ballot API coverage you chose at checkout (by contest or measure, by state, or every state), delivered as you choose, with updates.
- Coverage means contests and measures on upcoming ballots that we have collected. We don’t promise to cover any particular contest, measure, endorser or jurisdiction.
2. Your license
- While your subscription is active, you may use the data, copy it within your organization, combine it with other data, and publish or display it in your own products, analyses and reports.
- You may not resell, sublicense or redistribute the data itself, in bulk or as a feed or dataset that lets others reconstruct a substantial part of it, or offer it as a competing data product.
- Keep API keys, private links and postback secrets confidential; you’re responsible for their use.
- You may keep using data you received during your subscription after it ends, under these same limits, but you receive no further updates.
3. Payment, renewal and cancellation
- Subscriptions are billed yearly in advance through Stripe, at the prices on our site at checkout, plus any applicable tax.
- Each subscription renews automatically for another year unless you cancel before the renewal date. Cancel any time from your account’s billing page; you keep access until the end of the year you paid for.
- Payments are non-refundable except where the law requires otherwise or we agree in writing.
- If a payment fails, we may pause deliveries until it succeeds, and end the subscription if it doesn’t.
- We may change prices for future renewals with at least 30 days’ notice by email.
4. No service level agreement
We provide no service level agreement. Deliveries, files, the API, the stream and postbacks may be delayed, interrupted or unavailable at any time, including for maintenance, and no credit or refund is due for any delay or outage. Statements that updates “generally” arrive within the hour describe typical performance, not a commitment.
5. No warranty about the data
The data is collected from public sources, including endorsers’ own publications, and is provided “as is” and “as available”. We make no warranty and accept no responsibility for its accuracy, validity, completeness, timeliness or fitness for any purpose. Endorsers may change or withdraw recommendations, and ballots may change, after we collect them. You are responsible for checking the data before relying on it. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
6. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the data or the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
7. Your responsibilities
- Use the data lawfully, including election, campaign-finance and consumer-protection law.
- Don’t misrepresent an endorser’s recommendation or imply that an endorser or BallotData endorses you.
- Don’t try to get around coverage limits, rate limits or access controls.
8. Suspension and termination
We may suspend or end a subscription that breaks these terms, after notice where practical. You may end yours by canceling. Sections 2.4 and 4 to 10 survive.
9. Changes to these terms
We may update these terms. Changes apply from your next renewal, or sooner if you agree; we’ll email you about material changes. The version you agreed to is recorded with your purchase.
10. General
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, and disputes go to the state or federal courts in San Francisco County, California. If a provision is unenforceable, the rest stays in effect. These terms, and anything we agree in writing, are the whole agreement about your subscription.
